These Fiat Layer Terms ("Fiat Terms") govern card/bank purchases or sales of digital assets within the Baltex platform ("Fiat Layer"). They incorporate and supplement the Baltex Terms of Service and Privacy Policy. If there is a conflict, the Baltex Terms prevail for digital-asset services; these Fiat Terms govern fiat payment processing matters unless card/bank scheme rules or External Provider terms state otherwise.
2.1 Interface Only. Baltex provides the technical interface for initiating fiat-to-crypto and crypto-to-fiat flows.
2.2 No Control Over Banking Systems. Baltex does not operate card networks, bank rails, or clearing systems and cannot control processing times, authentication steps, approval/decline decisions, settlement periods, or FX rates set by those systems.
2.3 Availability. Access to the Fiat Layer may be suspended, limited, or modified for compliance, operational, or technical reasons without prior notice.
2.4 External Providers. Fiat transactions are facilitated through third-party payment service providers (e.g., card acquirers, processors, banks/e-money institutions, identity/KYC vendors, fraud-screening vendors) (collectively, "External Providers"). Baltex may add, remove, or replace External Providers at any time.
2.5 Your Agreement With External Providers. By proceeding with a fiat transaction, you agree to any terms, policies, and authentication flows required by the relevant External Provider and applicable card/bank scheme rules. Where there is a direct conflict regarding payment processing, the External Provider’s terms and scheme rules govern; Baltex Terms govern the delivery of digital assets.
You must be of legal age, legally permitted to use the Fiat Layer in your jurisdiction, and not subject to applicable sanctions. Use of the Fiat Layer is subject to Section 3 (AML/KYC) of the Baltex Terms, these Fiat Terms, External Provider requirements, and all applicable laws and regulations.
Fiat transactions may require verification and, where risk dictates, enhanced due diligence. You may be asked for government ID, selfie/liveness, proof of address, payment-method ownership evidence, and source-of-funds documentation. External Providers may conduct verification on their own behalf. Failure to complete verification can result in holds, cancellation, or funds being returned where lawful and technically feasible.
Use only payment methods you are authorized to use. Name mismatches, expired cards, blocked accounts, or suspected unauthorized use may result in decline, hold, or cancellation by Baltex or an External Provider.
6.1 Rates. Displayed rates are time-sensitive and based on market conditions until authorization and confirmation.
6.2 Fees. All applicable fees (including processing and network fees) are disclosed before you confirm; certain External Provider fees may appear as separate line items.
6.3 Limits. Per-transaction and periodic limits may apply and can change with verification level, risk profile, External Provider rules, and jurisdiction.
7.1 Auth Holds. An initial authorization may place a temporary hold on your payment method. Final capture can differ from the authorization due to rate movements, fees, or limits.
7.2 Strong Customer Authentication. External Providers may require 3-D Secure or other step-up checks.
7.3 Settlement Currency & FX. Settlement occurs in the currency shown at checkout; your issuer may apply foreign-exchange or additional fees. Baltex is not responsible for issuer or External Provider FX rates or charges.
Status may be shown in the Baltex interface where available. Processing times vary by method, verification status, External Provider workflows, market conditions, and network/banking constraints. Additional review extends timing.
Transactions may be cancelled or rejected for compliance, operational, or risk reasons by Baltex or an External Provider. If funds were captured and the transaction fails, Baltex (or the External Provider, as applicable) will process a return to the original payment method where feasible (see Section 12).
Card/bank rules may allow reversals or chargebacks initiated through your issuer or an External Provider. You are responsible for resulting fees, penalties, and negative balances attributable to your actions (including unauthorized use of a payment method). If a reversal occurs after digital assets are delivered, you authorize Baltex to pursue lawful recovery, including offsetting against future payouts or initiating collection where permitted.
Over-payments: Excess amounts may be returned to the original payment method, net of fees, where feasible (Baltex or the External Provider may process the return).
Under-payments: We may cancel or request the difference; if not resolved, the transaction may be reversed.
Duplicates: Duplicate payments may be reversed or refunded to the original method.
If a fiat transaction fails after funds are captured, a refund will be processed to the original payment method where feasible. Timing depends on card/bank networks, External Providers, and your issuer. Refunds arising from user error may incur fees disclosed during the flow and may also be subject to Fees and Penalties in the Baltex Terms.
You are responsible for accurate inputs (amount, currency, receiving wallet address, correct chain, required tags/memos). Sending to the wrong address or chain, or omitting a required memo/tag, can cause permanent loss. Baltex is not responsible for issuer/External Provider declines, holds, or posting delays.
Personal and transaction data necessary to operate the Fiat Layer, perform risk controls, and meet legal obligations are processed as described in our Privacy Policy. You authorize Baltex to share necessary data with External Providers (and their sub-processors) for payment processing, compliance (including KYC/EDD), fraud prevention, dispute/chargeback handling, and refunds.
The Fiat Layer may be unavailable or degraded due to maintenance, outages, peak demand, External Provider downtime, or regulatory actions. Baltex is not liable for such interruptions.
To the maximum extent permitted by law, the Fiat Layer is provided "AS IS" and "AS AVAILABLE." Baltex disclaims liability for losses or delays arising from payment networks, banking systems, External Providers, market conditions, outages, security incidents outside our reasonable control, regulatory changes, issuer decisions, or card/bank scheme rules.
Keep records of all payments and communications. For assistance, contact [email protected]. Some disputes must be raised directly with your issuer or the relevant External Provider and may be governed by card/bank scheme rules that can supersede portions of these Fiat Terms.
You agree to indemnify and hold Baltex, its affiliates, officers, employees, and agents harmless from claims, losses, damages, liabilities, and expenses arising from your use of the Fiat Layer, your interactions with External Providers, or your breach of these Fiat Terms.
Baltex may modify, suspend, or terminate the Fiat Layer, or update these Fiat Terms, at any time. Changes take effect upon posting unless a later date is stated. Continued use constitutes acceptance.
If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
